1. Загальні положення
1.1. Ця Публічна оферта є офіційною пропозицією Med Now укласти договір про надання доступу до функціоналу Платформи та організації онлайн-консультацій із лікарями на умовах, визначених у цьому документі.
1.2. Med Now є технологічною платформою телемедицини, яка забезпечує користувачам можливість пошуку лікарів, запису на консультації, проведення онлайн-комунікації, оплати консультацій і використання додаткових платних сервісів, зокрема підписки.
1.3. Ця Оферта є публічним договором. Акцепт Оферти Користувачем означає повну та безумовну згоду з її умовами, а також із пов’язаними документами Платформи, зокрема Terms of Service, Privacy Policy та Політика повернення коштів (Refund Policy).
2. Предмет договору
2.1. За цією Офертою Med Now надає Користувачу доступ до цифрової Платформи та її функціоналу, а також забезпечує технічну можливість замовлення і оплати консультацій або підключення підписки.
2.2. У межах Платформи можуть надаватися такі платні сервіси:
- разові онлайн-консультації з лікарями;
- підписка MEDNOW PRO або інші підписки, доступні на момент оформлення;
- інші цифрові сервіси або функції, якщо вони прямо відображені в інтерфейсі Платформи.
2.3. Med Now не є закладом охорони здоров’я та не надає медичні послуги напряму, якщо інше прямо не зазначено на Платформі. Платформа виступає організаційним та технічним посередником між Користувачем і лікарем.
3. Акцепт оферти
3.1. Акцептом цієї Оферти вважається одна або кілька з таких дій Користувача: реєстрація акаунта, оформлення запису на консультацію, оформлення підписки, натискання кнопки на кшталт «Оплатити», «Підтвердити», «Продовжити» або фактичне здійснення оплати.
3.2. Із моменту акцепту ця Оферта вважається укладеним договором між Користувачем і Med Now.
4. Послуги та запис на консультацію
4.1. Для отримання консультації Користувач обирає лікаря, доступний час, формат консультації та, за потреби, заповнює необхідні дані в профілі або формі запису.
4.2. Запис на консультацію вважається підтвердженим після успішного завершення всіх необхідних етапів бронювання, включно з оплатою, якщо для конкретної послуги передбачена попередня оплата.
4.3. Послуга консультації вважається наданою, якщо:
- консультація фактично відбулася;
- лікар був присутній у межах визначеного часу очікування, але Користувач не приєднався без належного скасування;
- Користувач отримав доступ до оплаченої підписки або іншого цифрового сервісу.
- Послуга вважається наданою незалежно від фактичної участі Користувача у консультації, якщо він не приєднався до неї без попереднього скасування відповідно до умов цієї Оферти.
5. Ціна та оплата
5.1. Вартість Послуг визначається Платформою та відображається Користувачу до моменту підтвердження замовлення. Ціна Послуги є актуальною на момент оформлення та оплати і може змінюватися до моменту здійснення платежу.
5.2. Med Now має право змінювати ціни в односторонньому порядку, але така зміна не впливає на вже оплачені замовлення.
5.3. Оплата здійснюється через доступні на Платформі платіжні методи. На момент оформлення деякі платежі можуть оброблятися через захищений checkout LiqPay.
5.4. Повні реквізити платіжної картки обробляються відповідним платіжним провайдером. Med Now не зберігає повні карткові дані Користувача.
5.5. Оплата Послуг здійснюється Користувачем у безготівковій формі за допомогою платіжних систем, доступних на Платформі. У разі, якщо інше не зазначено, оплата здійснюється у повному обсязі до моменту надання Послуги.
5.6. Доступ до Послуг, включаючи бронювання консультації або активацію підписки, надається лише після успішного підтвердження платежу.
6. Скасування, перенесення та no-show
6.1. Користувач має право скасувати або перенести запис на консультацію відповідно до правил, що відображаються на Платформі під час бронювання. Умови скасування, включаючи допустимі строки та можливість повернення коштів, визначаються для кожної Послуги окремо та є невід’ємною частиною цієї Оферти.
6.2. Якщо Користувач не приєднався до оплаченої консультації протягом передбаченого часу очікування і не скасував запис належним чином, така ситуація може вважатися no-show, а послуга — наданою без обов’язку повернення коштів.
6.3. Якщо лікар не приєднався до консультації протягом передбаченого часу очікування, Користувачу може бути запропоновано перенесення консультації або повернення коштів відповідно до Політика повернення коштів (Refund Policy).
6.4. У разі технічних збоїв з боку Платформи або інших підтверджених обставин Med Now може індивідуально визначити перенесення, повторне надання сервісу або повернення коштів.
7. Повернення коштів
7.1. Повернення коштів здійснюється відповідно до окремої Політика повернення коштів (Refund Policy), яка є невід’ємною частиною цієї Оферти.
7.2. Для вже активованих підписок рішення щодо повернення приймається з урахуванням факту активації, періоду використання, технічних обставин і правил, визначених у Політика повернення коштів (Refund Policy).
8. Відповідальність сторін
8.1. Med Now не несе відповідальності за неможливість користування Платформою, якщо така неможливість виникла з причин, що не залежать від Med Now, зокрема через дії або бездіяльність інтернет-провайдерів, банків, платіжних систем, пристроїв Користувача чи інших третіх осіб.
8.2. Користувач несе відповідальність за достовірність даних, наданих під час реєстрації, запису на консультацію та оплати.
8.3. Med Now не відповідає за зміст медичної консультації, діагноз, призначення, рекомендації чи будь-які індивідуальні медичні рішення, ухвалені лікарем.
9. Медичні застереження
9.1. Лікар надає консультацію на підставі інформації, наданої Користувачем, та власної професійної оцінки, однак не може гарантувати 100% результат лікування, одужання або досягнення очікуваного медичного ефекту.
9.2. Онлайн-консультації не замінюють екстрену медичну допомогу, невідкладне втручання, очний огляд або інші форми допомоги, коли вони є необхідними за медичними показаннями.

1. General Provisions
1.1. This Public Offer is an official proposal of Med Now to enter into an agreement for access to the Platform functionality and the arrangement of online consultations with doctors under the terms set out in this document.
1.2. Med Now is a telemedicine technology platform that enables users to find doctors, book consultations, communicate online, pay for consultations, and use additional paid services, including subscriptions.
1.3. This Offer is a public agreement. Acceptance of the Offer by the User means full and unconditional acceptance of its terms, as well as the related Platform documents, including the Terms of Service, Privacy Policy, and Refund Policy.
2. Subject of the Agreement
2.1. Under this Offer, Med Now provides the User with access to the digital Platform and its functionality, as well as the technical ability to order and pay for consultations or activate a subscription.
2.2. The following paid services may be available within the Platform:
- one-time online consultations with doctors;
- MEDNOW PRO subscription or other subscriptions available at the time of purchase;
- other digital services or features if they are explicitly displayed in the Platform interface.
2.3. Med Now is not a healthcare institution and does not provide medical services directly unless explicitly stated on the Platform. The Platform acts as an organisational and technical intermediary between the User and the doctor.
3. Acceptance of the Offer
3.1. Acceptance of this Offer is deemed to occur through one or more of the following User actions: account registration, booking a consultation, purchasing a subscription, clicking a button such as “Pay”, “Confirm”, or “Continue”, or actually making a payment.
3.2. From the moment of acceptance, this Offer is considered a binding agreement between the User and Med Now.
4. Services and Appointment Booking
4.1. To receive a consultation, the User selects a doctor, available time, consultation format, and, if required, fills in the necessary data in the profile or booking form.
4.2. An appointment is considered confirmed after all required booking steps have been successfully completed, including payment where prepayment is required for the specific service.
4.3. A consultation service is considered provided if:
- the consultation actually took place;
- the doctor was present within the applicable waiting time, but the User failed to join without proper cancellation;
- the User received access to a paid subscription or another digital service.
- the Service is deemed provided regardless of the User’s actual participation in the consultation if the User failed to join without prior cancellation in accordance with this Offer.
5. Price and Payment
5.1. The price of the Services is determined by the Platform and displayed to the User before the order is confirmed. The price of a Service is valid at the time of ordering and payment and may change until the payment is made.
5.2. Med Now may change prices unilaterally, but such changes do not affect already paid orders.
5.3. Payments are made through the payment methods available on the Platform. At the time of writing, certain payments may be processed through secure LiqPay checkout.
5.4. Full payment-card details are processed by the relevant payment provider. Med Now does not store the User’s full card data.
5.5. Payment for the Services is made by the User in cashless form using the payment systems available on the Platform. Unless otherwise specified, payment must be made in full before the Service is provided.
5.6. Access to the Services, including consultation booking or subscription activation, is granted only after successful payment confirmation.
6. Cancellation, Rescheduling, and No-Show
6.1. The User has the right to cancel or reschedule a consultation appointment in accordance with the rules displayed on the Platform during booking. The cancellation terms, including applicable deadlines and refund eligibility, are determined separately for each Service and form an integral part of this Offer.
6.2. If the User does not join a paid consultation within the applicable waiting period and does not cancel the appointment properly, such situation may be treated as a no-show and the service may be considered provided without an obligation to refund.
6.3. If the doctor does not join the consultation within the applicable waiting period, the User may be offered rescheduling or a refund in accordance with the Refund Policy.
6.4. In the event of technical failures on the Platform side or other confirmed circumstances, Med Now may determine rescheduling, repeated provision of the service, or refund on an individual basis.
7. Refunds
7.1. Refunds are made in accordance with the separate Refund Policy, which forms an integral part of this Offer.
7.2. For already activated subscriptions, refund decisions are made taking into account activation, period of use, technical circumstances, and the rules defined in the Refund Policy.
8. Liability of the Parties
8.1. Med Now is not liable for inability to use the Platform if such inability arises for reasons beyond Med Now’s control, including the actions or omissions of internet providers, banks, payment systems, the User’s devices, or other third parties.
8.2. The User is responsible for the accuracy of the data provided during registration, consultation booking, and payment.
8.3. Med Now is not responsible for the content of a medical consultation, diagnosis, prescriptions, recommendations, or any individual medical decisions made by the doctor.
9. Medical Disclaimer
9.1. The doctor provides a consultation based on the information supplied by the User and the doctor’s own professional assessment, but cannot guarantee a 100% treatment result, recovery, or achievement of the expected medical effect.
9.2. Online consultations do not replace emergency medical care, urgent intervention, in-person examination, or other forms of care where they are medically required.
